SPAM & Illegal/Copyrighted Files

Any account found sending spam or hosting illegal content and/or copyrighted content will be immediately suspended and, pending further investigation, may be terminated. We have a ZERO TOLERANCE policy when it comes to SPAM & illegal content. You may report abuse at contact@jetnethost.com.

JetNet Terms of Service Server Abuse:
Any attempt to undermine or cause harm to a server, or customer, of JetNet is strictly prohibited.

Any unauthorized use of accounts or computers by a JetNet customer, whether or not the attacked account or computer belongs to JetNet, will result in action. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

Accounts using more than 30% of system resources for longer than 60 seconds may be suspended and are in risk of being terminated with or without refund (determined by JetNet) pending further investigation.

Proxies may be allowed on a case-by-case basis. Often times, bandwidth usage from a proxy is not tracked by the control panel. Thus, if the bandwidth usage resulting from the proxy appears to be exceeding your limit, we may ask you to remove the proxy.

IMPORTANT NOTE - JetNet has the right to discontinue service, or deny access to anyone who violates our policies or the terms and conditions shown below WITHOUT WARNING OR PRIOR NOTICE. No refund of fees paid will be made if account termination is due to violation of the terms outlined. JetNet will suspend or terminate any account hosting illegal or infringing content following a valid complaint or DMCA. JetNet will comply with the authorities in any legal matter and will provide them with anything needed to pursue the owner of a site that hosts illegal or infringing materials. Though JetNet makes an effort to monitor the sites that they host, JetNet does not monitor all of them and will not be liable for any of the unacceptable uses of our hosting services: Unacceptable uses include, but are NOT limited to: Bulk emailing, unsolicited emailings, newsgroup spamming, pornographic content, illegal content, copyright infringement, trademark infringement, illegal MP3's, warez, cracks, software serial numbers, and/or anything else determined by JetNet to be unacceptable use of JetNet's services including abuse of server resources.

Your account may be terminated if your site is providing material that is grossly offensive, including blatant expressions of bigotry, racism, hatred, or profanity; promoting or providing instructional information about illegal activities; promoting physical harm or injury against any group or individual; displaying illegal material; displaying material that exploits children under 18 years of age; acts of copyright infringement including offering pirated computer programs; information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities.

MP3's:
Any MP3 that is not copyright by you, is NOT allowed on our servers. However, if the MP3 does not have a copyright, or if it only available for free via the internet (not SOLD in stores or on the internet) then it is allowed on our servers. If you are found with MP3's, your account will be suspended, and if you do not delete them, your site will be terminated.

Bandwidth and Disk Space:

Shared/Reseller Accounts:

Please note that if your account reaches its bandwidth limit, it will automatically be suspended for the duration of the month. If you wish to buy more bandwidth for the month, you can do so at a cost of $1.00 per 10GB of bandwidth. If you wish to buy more disk space, it is $1.00 per 1GB.

Dedicated Server Accounts:

JetNet often engages in partnerships with third-party server providers. Our dedicated server clients are bound by the terms of the data center and/or the third-party server company we resell for. Bandwidth overages or other additional costs that are charged to us because of a client's server must be paid by the client.

Abuse of Mail Server:
With certain exceptions, we do not allow clients to send more than 2,000 pieces of e-mail per day. If you do send more than 2,000 pieces of e-mail per day, your account may be suspended. If you plan on sending out more than 2,000 e-mails (non-spam), please inform us and we can work out a solution. If you do not inform us ahead of time, your account may either be suspended and terminated upon further investigation.

Background Running Programs:
We may allow programs to run continually in the background. These are considered on a one-to-one basis. Please contact us for additional information.

IRC:
We currently do not allow IRC or IRC bots to be operated on our servers.



Backups (Shared/Reseller Accounts):
Backups are made once per night and sent to a remote location. We strongly recommend to have a COMPLETE backup of your site/data on your computer at all times. We are not responsible for lost data on our servers. The files of hosting accounts that use more than 2GB of disk space will NOT be backed up. Only the MySQL databases that relate to those accounts will be backed up. Therefore, if you have a large site, we recommend that you keep a backup on your own computer.

Note: Free or "sponsored" accounts are not backed up.

Payment Policies:
All pricing is guaranteed for the term of monthly payments. JetNet reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within 10 days of e-mail notice is subject to suspension or termination.

Free Domain Name(s):
Select hosting plans include a free domain name for one year, which is normally a $10.99 value. Approximately one year after the claiming of this offer, the domain name price will return to normal and the customer will be billed $10.99.

Cancellation:
JetNet reserves the right to cancel service at any time. All fees paid in advance of cancellation will not be returned by JetNet if JetNet institutes it's right of cancellation. Any violation of policies which results in extra costs will be billed to the customer (i.e. bandwidth overages, etc.)

All of JetNet's web hosting plans are backed by a 30 day money-back guarantee. However, if you received a free domain name as an addition to a web hosting package, then the money-back guarantee does not apply. Otherwise, if you are not completely satisfied with our web hosting services during the first 30 days of service, you will be given a full refund of the service amount. For shared and reseller hosting services, the full contract amount less any overages will be refunded if JetNet is notified during the first 30 days of service following activation. No refund is available after 30 days. The date when you first ordered your account and the date of cancellation both count as a full day each. This money-back policy does not apply to dedicated servers, domain name registration or any additional services such as overages, referrer logs, real audio/video, disk space, bandwidth, IP addresses, pop accounts, etc.

To cancel service, please either submit a support ticket through the billing system (http://clients.jetnethost.com) or e-mail the Billing Department (billing@jetnethost.com). In the ticket or e-mail provide the following information: First Name, Last Name, Domain Name, Username, Password and Reason for Canceling. One of our representatives will then review your request and cancel your account. If you have a Paypal subscription setup, it is your responsibility to cancel it. If you do not cancel the Paypal subscription and we receive payment on the specified due date, you will not be refunded.

Uptime:

Shared/Reseller Accounts:

JetNet guarantees 99.9% uptime! With the exception of rare emergencies, in the event that we must take a server down for maintenance, we will give our customers at least 24 hours notice with exactly what time(s) it will be down and for how long. In the seldom event that there is unscheduled downtime, the customer is subject to a refund for the downtime (upon request; valid for 48 hours after downtime event).

Dedicated Server Accounts:

Please ask us about our policy for dedicated server uptime. JetNet often engages in partnerships with third-party server providers, therefore our uptime policy will change based on the third-party we are dealing with.

Lawful Purpose:
JetNet reserves the right to refuse service to anyone. Customers may only use JetNet server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The designation of any materials as such described above is left entirely to the discretion of JetNet management.

Terms of Service:
JetNet reserves the right to add or modify the terms of service, listed above, at any time. Upon such an addition or modification, customers (current or new) must abide by these changes.
